TERMS OF SERVICE
LAST UPDATE:[19-07-2025]This contract applies to the artist further called the Author and person or institution further called the Customer purchasing from the Author an illustration or writing, further called Product. By ordering the Product from the Author the Customer agrees to the following terms and conditions:PAYMENTS
1. The Customer agrees to pay the due amount upfront for any order.
2. The Customer accepts that work on the Product will not commence until the payment has been received by the Author.PRODUCT DELIVERY
3. The Customer agrees that the Product will be delivered digitally to the email address provided by the Customer, after the work is finished by the Author.
4. Any other method of delivery not established here, either digital or physical, has to be mutually agreed before the work starts. The Customer is obliged to bear any costs incurred by the alternative delivery method, such as postal costs, material costs, digital service subscription fees, etc.
5. In this case, it's the responsibility of the Customer to propose the delivery method which works for both parties. The Author cannot be held accountable for the Customer's loss of access to the delivery method, loss of the delivered files, impediments such as spam filters or any other technical obstacles outside the responsibility of the Author.
6. Upon the delivery of the product, it's the Customer's responsibility to store it properly. Loss of the product due to negligence will not be reimbursed by the Author. The Author cannot guarantee that the original copy of the final product will be available in the case that the Customer lost their files.REVISIONS
7. The Customer has the right to 2 complete revisions in the drafting phase.
8. The Customer has the right to a reasonable amount of minor edits after completion, such as changing or fixing a small detail, that doesn't take up to an additional 10% of the total time spent on creating the final delivered Product. Any requests above that, no matter how insignificant these are, will require a prior mutual agreement and will result in a proportional increase of the order value. Such increase will be invoiced separately. Working on the new requests will not commence until the payment for the additional invoice(s) has been received.CURRENCY CONVERSIONS
9. The Customer agrees to pay the total amount specified in CLP on the price.
10. It is the sole responsibility of the Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Author.
11. Payment is considered as received as well as the order is taken only when the total amount of the pricing of the commision is on the Author's (CLP) bank account and this is equal to the total of the order requested.REFUND POLICY
12. The Customer has the right to request a full refund only if there's been no progress for a month and a half, or when the Product has not been completed within three months. There won't be refund for invoices over small details. These circumstances exclude work interruptions caused by unforeseen situations, such as an illness, accident or any other documented reason for interruption of the work.
13. The Customer must contact the Author in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of the Customer will be assumed as an implicit approval of the current work in progress and the current state of the Product.PERSONAL AND COMMERCIAL USE
14. The Product received by the Customer is for personal use. Any use of the Product for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Author. This will require a separate agreement between the Customer and the Author defining the exact conditions and financial implications of the use of the Product.15. The Customer does not hold the right to use the product in any blockchain-related technology, including NFTs, cryptocurrency, AI related technology, datasets or future inventions in the future.CANCELLATIONS
16. The Author holds every right to refuse or cancel any order, under the condition of a full refund, without giving any explanations to the Customer.
17. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. The Customer will receive full or partial refund depending of the amount of work completed. The Author will hold the right to refuse any future services to the Customer due this circumstances.
